Terms and Conditions

1. OPEN Savings®: Payment must be made with an American Express® Business Card at the time of purchase. Savings will be credited to your American Express Business Card billing statement. All savings referenced are in addition to any offers made by participating companies. Participation and offers are subject to change without notice. Terms and conditions apply. OPEN Savings purchases are defined as purchases made at BizFilings, Ceridian, Constant Contact®, Courtyard by Marriott®, Delta®, eSkyGuide, ExpensAble, Fairfield Inn by Marriott®, FedEx Express®, FedEx Ground®, FedEx Kinko’s Office and Print Centers®, Gateway, Hertz®, Hyatt Hotels & Resorts®, JetBlue®, Logoworks®, Ruby Tuesday®, SpringHill Suites by Marriott®, Symantec, Wingate Inns®, and 1-800-FLOWERS.COM®.

2. The American Express Card has no pre-set spending limit which provides purchasing power that adjusts with the use of the Card. No preset spending limit does not mean unlimited spending. Purchases are approved based on a variety of factors, including current spending patterns, payment history, credit record, and financial resources known to us.

3. The annual fee of $125 for your Basic card is waived for the first year of your membership. The annual fee of $45 per additional Business Gold Rewards Card is waived for the first year if added during the first year of your membership.

4. The annual fee for the Membership Rewards® program is $40. Some Business Cards from OPENSM the small business team and some Corporate Cards are not eligible for enrollment. Fees and terms for Business Cards and Corporate Cards may vary. For Platinum Card® members, Rewards Plus Gold Card members, Membership Rewards Credit Cardmembers, Business Membership Rewards Cardmembers, Business Gold Rewards Cardmembers, Business Platinum Card® members and Business Centurion® Card Members, there is no annual program fee for the Membership Rewards program. There will be an additional $10 annual fee for each Business Card linked to a Membership Rewards account with other enrolled Charge Cards. The $10 annual linkage fee will not be assessed if the Cardmember has a Platinum Card, a Business Platinum Card, any Additional Card of a Business Platinum Card, an Executive Business Card, any Additional Card of an Executive Business Card, a Business Centurion Card, any Additional Card of a Business Centurion Card or a Fidelity American Express® Platinum Card linked to the same Membership Rewards account. Participating partners subject to change.

5. Bonus $100 savings applies to your first purchase made on or before 12/31/07, and will appear as a statement credit on your monthly billing statement. Maximum discount available is $100 per Card account.

6. The introductory APR for purchases is 0% for the 1st 6 months, then the standard APR for purchases will apply. The APRs for purchases are 11.24%, 12.24%, 15.24%, 18.24% as of 8/7/07.

7. You will receive a monthly Rebate on the amount of your Purchases (net of credits for Purchases) made during the previous billing period based on the following structure: You will receive a Rebate of 5% for Purchases of wireless telephone services, automobile gasoline, and office supplies and equipment, in each case not purchased at a warehouse club, superstore or supermarket (“5% Purchase(s)”). You will receive a Rebate of 1% for Purchases in all other categories (“1% Purchase(s)”). You will receive a 5% Rebate only if the merchant submits the Charge for your 5% Purchase under the appropriate merchant code, industry code and required service or product identifier established by us and the merchant. If the merchant submits a Charge for a 5% Purchase under a different merchant code, industry code or required service or product identifier, you will receive a Rebate of 1%, not a Rebate of 5%. You will not receive a Rebate for balances transferred from other accounts, Purchases of American Express Travelers Cheques or American Express Gift Cheques, fees, Finance Charges, Cash Advances and similar means of accessing your Card Account, and Purchases made outside the United States.
